Polish is the most spoken language in England and Wales after English
In the 2021 Census, Polish was recorded as the most common main language in England and Wales other than English, with 612,000 speakers — ahead of Romanian, Panjabi and Urdu (ONS, Language, England and Wales: Census 2021). A large share of that community is self-employed or running limited companies, particularly in construction, transport, hospitality and the trades.
Three things we are asked constantly, and almost nobody writes about
CIS — the Construction Industry Scheme for subcontractors
If you work as a subcontractor in UK construction, your contractor deducts money from your payments before you receive them and passes it to HMRC. Whether you have paid too much depends on your costs and your status, and many subcontractors are owed a repayment without realising it. Registering under CIS, keeping the right records, and reclaiming through Self Assessment or a company return is routine work for us. We will tell you what your deduction rate should be and whether gross payment status is realistic for you.
A1 certificates and posted workers
If you move between the UK and Poland for work, an A1 certificate determines which country's social security system you pay into, so you are not paying twice. Whether you need one, and who applies, depends on whether you are employed, self-employed, or working in both countries. This is separate from income tax and it is frequently missed.
Sending money home to Poland
Sending part of your UK earnings to family in Poland does not, by itself, create a UK tax charge. What matters is where your income arises and where you are tax resident — not what you do with money after it has been taxed. If someone has told you otherwise, get it checked before you act on it.

Polish companies delivering projects in the UK — engineers, installers and contractors
A growing number of Polish engineering, installation, fit-out and manufacturing companies win contracts in the UK and send their own teams to deliver them. The work is usually done through the Polish company, not a UK one, and that is often the right answer, but four UK rules have to be checked before the first worker arrives.
- Permanent establishment — under Article 5 of the 2006 UK–Poland Double Taxation Convention a building site, construction or installation project constitutes a permanent establishment only if it lasts more than twelve months. Beyond that point the profits attributable to the UK project are taxable in the UK and a UK corporation tax registration is needed (main rate 25% above £250,000 of profit, 19% at £50,000 or below).
- VAT — a Polish company with no UK establishment is a non-established taxable person and has no UK VAT registration threshold: HMRC requires notification regardless of the value of the taxable supply. If the customer is a UK VAT-registered business the reverse charge may shift the VAT to them, so the answer depends on who the customer is.
- CIS — the Construction Industry Scheme applies to construction operations carried out in the UK whoever carries them out. Unregistered subcontractors suffer a 30% deduction, registered subcontractors 20%, and gross payment status gives 0%. HMRC has a dedicated registration for non-resident companies; registering before the first payment is the biggest cash-flow saving on a UK project.
- Posted staff — Article 14 of the convention keeps an employee's pay taxable only in Poland if they are in the UK for no more than 183 days in any twelve-month period, the employer is not UK resident and the cost is not borne by a UK permanent establishment. For social security, a posting of up to 2 years can stay in ZUS with a PDA1 certificate of coverage. If a UK place of business opens, Companies House form OS IN01 is due within one month.
We map all four before the project starts, register what needs registering, and run the UK VAT, CIS and payroll compliance while your team concentrates on the site.
14; zaświadczenie A1/PDA1 do 2 lat pozwala pozostać w ZUS). Pracujemy po angielsku, z profesjonalnym tłumaczeniem na język polski. Sprawdzamy wszystkie cztery punkty przed rozpoczęciem projektu i prowadzimy rozliczenia VAT, CIS i listy płac w UK.
How we work
TaxDigit works remotely with clients across the whole UK from its Guildford head office — video meetings at a time that suits you, documents exchanged securely online, and a named point of contact rather than a call centre. Fees are agreed in advance.
Communication is in English, supported by professional Polish translation. We are explicit about this because it matters: TaxDigit is a UK-regulated firm giving UK advice. We are not entered on the Polish register of doradcy podatkowi or biegli rewidenci, we do not use those titles, and we do not give Polish domestic tax advice. Where you need Polish-side advice, we work alongside your adviser in Poland.

FAQs
I am a subcontractor and tax is taken off my payments. Is that right?
Under CIS, contractors deduct from subcontractor payments and pass it to HMRC as an advance payment towards your tax and National Insurance. Whether the deduction rate applied to you is correct depends on your CIS registration status, and whether you end up owed money depends on your allowable costs. We check both.
Do I need to file a UK tax return if I also work in Poland?
It depends on your UK residence status and where your income arises. The UK-Poland double taxation convention determines which country taxes what. We will look at your specific facts rather than give you a general answer.
Can you deal with HMRC for me?
Yes. Once you appoint us as your agent, we can speak to HMRC about your affairs and file on your behalf.
Are you Polish accountants?
We are a UK firm of chartered certified accountants (ACCA) serving Polish-speaking clients. We are not registered with a Polish professional body and we do not give Polish domestic tax advice.
Our Polish company has a contract to install equipment in the UK. Do we need a UK company?
Not necessarily. A Polish company can deliver a UK installation contract through its Polish entity. What must be checked is whether the project will exceed twelve months (a permanent establishment under Article 5 of the UK–Poland convention), whether UK VAT registration is required from the first invoice as a non-established business, whether the work falls within the Construction Industry Scheme, and how long each engineer will be in the UK. A UK subsidiary becomes the better route when the work is continuous.
Does CIS apply to a Polish subcontractor company working in the UK?
Yes. CIS depends on where the construction work is done, not where the company is based. Until a non-resident company registers with HMRC, the UK contractor deducts 30% from the labour element of each payment; after registration 20%; with gross payment status 0%. We register the company under the dedicated non-resident route and apply for gross payment status where the tests are met.
Do our engineers pay UK income tax if they only come for a few months?
Usually not, provided three conditions in Article 14 of the UK–Poland convention are met: no more than 183 days in the UK in any twelve-month period, an employer that is not UK resident, and pay that is not borne by a UK permanent establishment. Social security is separate: with a PDA1 certificate of coverage a posting of up to 2 years stays in ZUS. We monitor the day counts and set up a UK PAYE scheme only if it becomes necessary.
Does a Polish company have to register for UK VAT for one project?
A business with no UK establishment has no UK VAT threshold, so registration can be required from the first taxable supply. Where the customer is UK VAT-registered the reverse charge can move the VAT to the customer, and construction work has its own domestic reverse charge. We confirm which rule applies before the first invoice.
